What is the penalty for not registering as a sex offender?

The penalty for failing to register as a sex offender is conviction of a crime that is considered a felony. If it is a first conviction, it can be punished as a Class E felony. If it is a second or later conviction, it can be punished as a Class D felony.

Level 1, or low risk, offenders are required to register for 20 years, unless they possess a designation, such as sexual predator, sexually violent offender or predicate sex offender. In that case, they are required to register for life. Level 2, or moderate risk, offenders and Level 3, or high risk, offenders are required to register for life.
