Commissioner Of Education Appeals And PERB Lawyer

Commissioner of Education Appeals and the Public Employees Relations Board (PERB) provide important levers of accountability for public employees. According to their respective websites:

Education Law §310 provides that persons considering themselves aggrieved by an action taken at a school district meeting or by school authorities may appeal to the Commissioner of Education for a review of such action. In addition, Education Law §306 allows the Commissioner of Education to remove a trustee, member of a board of education and certain other school officers for willful misconduct or neglect of duty.

Procedures for the presentation and defense of such appeals and for the conduct of proceedings for the removal of school officials are contained in regulations of the Commissioner of Education.

PERB was created by the Public Employees’ Fair Employment Act of 1967, and its mission is the enforcement of the Act; the protection of the rights of public employees to organize without interference or detriment; the assurance that public employers and employee representatives will engage in good faith collective bargaining to determine public employees’ terms and conditions of employment: the determination of appropriate bargaining units and the direction of the process of representative selection; and issuance of determinations on charges of improper employment practices.

While these outlets provide for transparency and fairness in public employment, navigating the complex waters of these issues requires comprehensive knowledge. We are prepared to bring our years of disciplinary hearing experience to help you ideally resolve any issue.
