Staten Island truck driver arrested for DWI, Breathalyzer refusal in crash with cops

A truck driver is facing driving while intoxicated (DWI) charges in connection with a crash that injured five NYPD police officers. He allegedly refused to take a Breathalyzer test, an offense that typically leads to further penalties on top of the original charge.

Police identified the truck driver as Brian Manning, 39. His pick-up truck struck officers who were setting up barriers for a Memorial Day parade on Staten Island. The collision occurred around the intersection of Forest Avenue and Livermore Avenue.

Police said Manning, who remained at the scene of the accident, was allegedly drunk. He was arrested and charged with DWI, refusal to take a Breathalyzer test, driving without a license and reckless assault.

At least three of the officers were in plain clothes. Four were transported to Richmond University Medical Center with minor injuries.

Under New York law, drivers who have been arrested on suspicion of drunk driving are required to take a formal breath test to measure blood alcohol content. Refusing a Breathalyzer can lead to a loss of your driver’s license and fines. It also does not stop you from being charged with DWI.
