Criminal records wiped clean as New York legalizes recreational marijuana

Recreational marijuana has remained illegal in New York up until recently. Anyone found possessing even a small amount of the drug was at risk of facing fines and jail time. However, the passage of a new bill that loosens New York’s marijuana laws signals some significant changes.

Gov. Andrew Cuomo signed the Marijuana Regulation and Taxation Act into law on March 31, legalizing recreational marijuana. The legislation ends criminal penalties for possession, use and cultivation of marijuana. Law enforcement will no longer be able to arrest adults 21 and over for possessing and using up to three ounces of marijuana.

New York will also automatically expunge the criminal records of individuals with certain past convictions for the possession or sale of marijuana. This means anyone currently behind bars or on parole for marijuana-related offenses can petition for release.

The law also provides protections for marijuana use in public spaces such as workplaces, family courts, colleges and universities. Smoking or vaping marijuana, however, is not allowed in certain locations under state law.

Under the new legislation, the sale of recreational marijuana will soon become legal. Any sales that violate regulations are still illegal.

Some parties, including law enforcement organizations, have opposed marijuana legalization. One concern is that it will lead to impaired driving and more motor vehicle accidents. State officials are planning to research the extent to which marijuana affects driving abilities.
