New York Medicaid Issue Defense Attorney

In the past few years, Medicaid oversight has increased substantially and the Office of the Medicaid Inspector General (OMIG) has devoted significantly more time and resources to Medicaid audit and enforcement actions. In an effort to ratchet up compliance efforts, the state has been legally obligated to recover Medicaid overpayment, fraud and abuse — failure to do so results in loss of federal subsidies. The result of this mandate has been an unprecedented level of oversight and scrutiny around Medicaid.

The Deficit Reduction Act of 2005 (DRA) forced health care providers who received $5 million or more in Medicaid revenues to have certain written compliance policies in place with respect to billing and payments. Since 2009, the new regulations have forced compliance in the areas of care quality, governance, mandatory reporting and credentialing. This doesn’t exempt smaller providers from scrutiny though, and consistent compliance and planning is expected throughout the industry.
