New York Mental & Health Care Provider Defense Lawyer

Recently, New York Governor Andrew Cuomo created an agency called the Justice Center to police health care workers alleged to have committed serious abuse or neglect offenses against people of special needs.

This adds yet another agency to investigate and prosecute health care workers in New York, in addition to the OPD, OPMC, DOH and Attorney General, to name a few.

Per the agency’s mandate, the Justice Center has primary responsibility for tracking, investigating, prosecuting or otherwise pursuing serious abuse and neglect complaints for facilities and provider agencies that are operated, certified, or licensed by the following six agencies: Office of Mental Health (OMH), Office for People with Developmental Disabilities (OPWDD), Office of Children and Family Services (OCFS), Office of Alcoholism and Substance Abuse Services (OASAS). Also covered are certain adult homes operated by the Department of Health (DOH), and residential schools and programs certified or operated by the State Education Department (SED).

The Justice Center also has its own Office of Investigations, which is staffed by experienced and highly-trained law enforcement officers who thoroughly investigate allegations of abuse, neglect and misconduct received by the Justice Center. Their responsibilities include collecting and preserving all relevant documents and physical evidence that support such allegations. This evidence is used to pursue administrative sanctions and/or the criminal prosecution of employees who abuse people with special needs or who otherwise violate the law and/or the policies of the agencies where they work.
