Woman cleared of prostitution charge in case of mistaken identity

An aspiring teacher got her name cleared from a prostitution charge that resulted when her older sister used her name for identification when she was stopped by police.

Jaclyn Humienny, 20, had to seek legal help from an attorney to prove to police that she was not a prostitute and that it was actually a case of mistaken identity. Her sister, 24-year-old Samantha Humienny, was stopped by police in Paterson, New Jersey, on a prostitution-related charge in November. Samantha misidentified herself as Jaclyn instead of providing her real name.

Jaclyn is studying to become a teacher in Florida. She found out about the situation when the pending charges emerged during a work-related background check. “Having a potential criminal record could literally ruin my future career as a teacher,” she said in a TV interview.

According to officials, Samantha failed to appear in court to face the charges. As a result, Jaclyn received a court notice stating she owed $533 in fines. It also said that an arrest warrant would be issued for her if she failed to pay. When Jaclyn called Paterson police, they told her “there was nothing they could do.”

A Municipal Court judge said the evidence she had sent to prove she was in Florida when the incident occurred was insufficient to clear her name from the prostitution record. Jaclyn decided to hire an attorney. Soon after the judge dismissed the pending criminal charges against her and agreed to waive any related fees. Jaclyn said the authorities should have done more to verify her sister’s identity.
