Man pleads guilty to injuring infant in domestic violence case

A man in Gloversville, New York pleaded guilty to reckless endangerment in the first degree after he was arrested for assaulting a two-month-old infant. An order of protection was also sought for the child.

Marcus E. Ralbovsky, 29, fractured the baby boy’s skull during a domestic incident in September 2017. He accepted a plea agreement in which the district attorney recommended a split sentence consisting of a six-month jail sentence and five years of post-release supervision.

Gloversville police launched an investigation following a tip left on the New York State Child Abuse Hotline and later arrested Ralbovsky. They initially charged him with second degree assault in October 2017 for hitting the infant’s head. The baby was hospitalized at Albany Medical Center after his skull was fractured. The parties involved in the domestic violence incident failed to report the injury to police.

Domestic violence allegations such as assault often go hand in hand with an order of protection for the alleged victim. A judge may issue one of two types of orders. A stay away order prohibits a person from contacting the victim, whether by phone, email or in person. A limited order allows contact between the individuals as long as there is no threatening or abusive conduct toward the protected person.
