Police departments on Long Island and in NYC have a "must arrest" policy. When police are called to a domestic abuse situation, at least one person (usually the man) will be taken into custody.
After a night in jail, the person appears before a judge on charges of assault, aggravated assault (bodily harm), harassment, aggravated harassment, stalking or reckless endangerment. The court almost automatically errs on the side of the alleged victim; the judge will usually issue a restraining order and may even order anger management classes as a condition of release.
